Terms and Conditions

Rangoli Lens – Martina Šilarová
Řetová 186, 561 41 Řetová, Czech Republic
Business ID: 07136447

Effective from 1 January 2026

I. TERMS AND CONDITIONS

These Terms and Conditions form an integral part of the photography services agreement concluded between the Client and the Photographer. The subject of the agreement is the creation of photographic works and the provision of photography services by the Photographer.

The current price list of the Photographer forms an integral part of these Terms and Conditions.

These Terms and Conditions become effective on 1 January 2026.

The contractual relationship between the Client and the Photographer is governed by the laws of the Czech Republic, in particular Act No. 89/2012 Coll., the Civil Code, as amended (hereinafter referred to as the "Civil Code").

II. PHOTOGRAPHER

The Photographer means:

Rangoli Lens – Martina Šilarová
Řetová 186
561 41 Řetová
Czech Republic
Business ID: 07136447
(hereinafter referred to as the "Photographer")

III. CLIENT

The Client means a natural person over the age of 18 who contacts the Photographer with a request for the creation of photographic works and provision of photography services.

IV. PHOTOGRAPHY SERVICES AGREEMENT

By entering into the Photography Services Agreement, the Photographer agrees to create photographic works for the Client at a previously agreed date, capturing the Client (or, based on an explicit agreement between the Client and the Photographer, other persons) in the agreed style, theme, and scope selected from the Photographer's current packages.

The Photographer agrees to deliver the final photographic works to the Client in digital form.

The Client agrees to pay the agreed price for the selected package and to provide the Photographer with all necessary cooperation required for the proper performance of the service.

V. BOOKING A PHOTOGRAPHY SESSION / DATE RESERVATION

The Client may request a photography date by phone, via Facebook or Instagram message, or by email: martina@rangolilens.cz

The Photographer will first confirm whether the requested date is available.

To reserve the date, the Client must pay a deposit of 50% of the agreed package price to the Photographer's bank account within 3 days of the date confirmation (hereinafter referred to as the "Deposit").

If the Deposit is not credited to the Photographer's bank account within this period, or the Client does not provide other verifiable proof of payment (for example, a payment confirmation), the booking will automatically be considered not accepted and the date may be offered to another Client.

For wedding photography, the date is considered reserved only after payment of a booking fee equal to 50% of the total agreed service price. This booking fee is included in the final price of the service.

By placing an order and making the required payment, the Client confirms that they have read and accepted these Terms and Conditions, the current price list of the Photographer, and the Photographer's photographic style and portfolio.

VI. CONCLUSION AND CHANGES TO THE PHOTOGRAPHY SERVICES AGREEMENT

The Photography Services Agreement is concluded on the day the agreed payment is credited to the Photographer's bank account (the deposit for regular photography sessions or the booking fee for wedding photography).

The Photographer reserves the right to change the agreed photography date in exceptional circumstances after the agreement has been concluded. The Photographer is obliged to inform the Client without unnecessary delay and arrange an alternative date that is acceptable to both parties.

The Client is not entitled to change the agreed photography date unilaterally. If the Client is unable to attend the scheduled photography session due to serious reasons, they must inform the Photographer without unnecessary delay.

VI.a. EXTRAORDINARY CIRCUMSTANCES

In the event of serious unforeseen circumstances, especially sudden illness, injury, or another obstacle that objectively prevents the Photographer from providing the agreed photography service, the Photographer shall inform the Client without unnecessary delay.

In such a situation, the Photographer will attempt to arrange a suitable replacement photographer with a comparable style and experience.

However, arranging a replacement photographer cannot be guaranteed and depends on the availability of other photographers at that time. Any replacement photographer is subject to the Client's approval.

If it is not possible to arrange a replacement photographer, or the Client does not accept the proposed alternative solution, any payments made for the services that cannot be provided will be refunded to the Client.

VII. PRICE OF THE SERVICE AND PAYMENT TERMS

The price of the service depends on the type of photography package selected.

The due date for the Deposit is specified in Article V of these Terms and Conditions.

The remaining balance of the service price is payable either in cash or by bank transfer on the agreed photography date, immediately after the photography session has been completed.

The Client will receive a payment confirmation/invoice electronically by email within 3 days after the photography session together with the preview gallery.

If the Client orders additional photographs beyond the agreed package, the price for these additional photographs must be paid to the Photographer's bank account within 3 days from the date the Client selects the additional photographs for editing.

The delivery time for the final edited photographs will be extended by the period of any delay caused by the Client's failure to make the required payment.

VIII. CLIENT'S RESPONSIBILITIES

The Client is obliged to provide the Photographer with all necessary cooperation required for the proper completion of the service.

In particular, the Client is obliged to arrive at the agreed location at the agreed time (neither earlier nor later unless agreed otherwise with the Photographer).

The Client is responsible for arranging their own transportation to the photography location.

A late arrival by the Client does not constitute a reason for extending the scheduled photography time.

If the Client fails to provide the necessary cooperation to the Photographer (especially by not attending the scheduled session or arriving late without prior notice), this will be considered a substantial breach of the Client's obligations.

IX. COURSE OF THE PHOTOGRAPHY SESSION

The Photographer is not responsible for any harm or damage caused to the Client during the photography session by third parties.

Any accompanying person of the Client may attend the photography session only with the prior agreement of the Photographer and only at the agreed photography location.

The accompanying person must follow the Photographer's instructions. If they fail to do so, the Photographer may request that they leave the photography location.

The following situations are considered a substantial breach of the Client's obligations under the Photography Services Agreement:

  • the Client or their accompanying person behaves in an inappropriate, offensive, immoral, or unlawful manner;

  • the Client or their accompanying person refuses to follow the Photographer's reasonable instructions;
  • the Client arrives for the photography session in a condition that prevents the proper completion of the service, including intoxication or a serious health condition;
  • the Client or their accompanying person takes photographs or audiovisual recordings during the session without the Photographer's consent;
  • when photographing children under the age of 15, the Client fails to ensure that at least one parent or legal guardian is present during the photography session.

X. DELIVERY OF THE AGREED NUMBER OF PHOTOGRAPHS

Within 3 days after the photography session, the Photographer will send preview images to the Client via the agreed communication channel (email, Facebook, or Instagram).

All preview images are provided in reduced quality, remain the copyrighted work of the Photographer, and may not be shared, published, or otherwise distributed.

Preview images are intended solely for the Client's selection of photographs for final editing.

The final delivered work consists only of the agreed number of professionally edited photographs delivered to the Client in digital format and print quality.

The Photographer will usually deliver the agreed number of edited photographs within 14 days after the Client has selected the photographs for editing.

In case of force majeure, illness, an unusually high workload, or other exceptional circumstances, the Photographer reserves the right to extend this delivery period.

Any additional requests or changes requested by the Client may extend the delivery time.

Wedding photographs will be delivered no later than 8 weeks after the wedding date.

The service is considered completed once the edited photographs have been sent to the Client's email address, Facebook message, Instagram message, or once the download link to the online gallery has been provided.

The Photographer is not obliged to resend the download link if the Client fails to download the photographs within the available period.

The Client may request express delivery of edited photographs for an additional fee of 2,500 CZK, with delivery within 1 week from the Client's selection of photographs for editing.

This express service does not apply to wedding photography.

If the Client does not select the agreed number of photographs for editing within 1 month from receiving the preview gallery, the Photographer may extend the editing period according to their current availability or withdraw from the agreement.

In such a case, the Photographer is entitled to a contractual penalty equal to the price of the agreed service package.

XI. PHOTO EDITING AND BACKUP STORAGE

THE PHOTOGRAPHER DOES NOT PROVIDE UNEDITED PHOTOGRAPHS OR RAW FILES TO THE CLIENT.

The price of the service includes basic skin retouching and adjustments such as softening or reducing visible imperfections.

Unedited photographs are stored by the Photographer for a maximum period of 2 months from the date of the photography session.

During this period, the Client may order additional edited photographs beyond the agreed package.

Edited photographs are stored by the Photographer for a minimum period of 3 months from the date of delivery to the Client.

XII. CLAIMS AND COMPLAINTS

The Client is obliged to carefully review the delivered photographic works immediately after receiving them.

If the Client discovers a defect that may constitute a failure of the Photographer to provide the agreed service, the Client must notify the Photographer without unnecessary delay, no later than 14 days after delivery, by email: martina@rangolilens.cz

The Client must specify the nature of the claimed defect.

The Photographer will assess the complaint within 30 days from receipt.

If the complaint is considered justified, the Photographer will correct the defect or provide an appropriate discount from the service price.

If the complaint is considered unjustified, the Photographer will inform the Client within 30 days.

A defect may include, for example, delivery of fewer edited photographs than agreed.

The Client acknowledges that the photographs are edited according to the Photographer's artistic style and creative vision. The Client is therefore expected to review the Photographer's portfolio before booking the service.

Dissatisfaction with the Photographer's style, artistic approach, editing style, or creative decisions does not constitute grounds for a complaint.

A complaint cannot be based on dissatisfaction with the Client's appearance, makeup, clothing choice, or similar personal preferences.

XIII. WITHDRAWAL FROM THE AGREEMENT

A Client who is a consumer and who enters into the Photography Services Agreement remotely (for example online) has the right to withdraw from the agreement without giving a reason within 14 days from the date of concluding the agreement, by sending a written withdrawal notice to: martina@rangolilens.cz

This right does not apply in cases specified below.

If the Photography Services Agreement is concluded less than 14 days before the scheduled photography date, the Client expressly agrees that the Photographer may begin providing the service before the expiry of the 14-day withdrawal period.

In such a case, the Client loses the right to withdraw from the agreement.

The Photographer may withdraw from the agreement, even after the service has started, if the Client substantially breaches obligations arising from the law or the agreement.

In such a case, the Photographer is entitled to a contractual penalty equal to the price of the service. The Photographer's right to compensation for damages remains unaffected.

XIV. GIFT VOUCHERS

Gift vouchers are valid for 10 months from the date of issue, unless a different validity period is stated directly on the voucher.

After the expiry date, the gift voucher becomes invalid without any entitlement to a refund of the amount paid.

Gift vouchers cannot be exchanged for cash.

Gift vouchers are transferable to another person.

A Client using a gift voucher must request a photography date at least 1 month before the expiry date of the voucher.

If the Client fails to do so, the Photographer cannot guarantee availability of a suitable date due to possible booking capacity.

The Photography Services Agreement with a Client using a gift voucher is concluded on the day the photography date is agreed.

From this moment, the scheduled photography date becomes binding for the Client.

Any later change of date is possible only by individual agreement with the Photographer.

If a Client using a gift voucher cancels or requests a change of date less than 10 days before the scheduled photography session, the Client is required to pay a cancellation fee equal to the price of the package stated on the gift voucher.

XV. COPYRIGHT AND OWNERSHIP RIGHTS TO PHOTOGRAPHS

All photographs and preview images are protected by copyright and remain the intellectual property of the Photographer.

The Client receives a personal, non-exclusive, non-transferable, non-commercial licence to use the delivered edited photographs for private purposes, including personal printing and sharing on personal social media accounts.

When sharing photographs online, the Client is kindly requested to credit the Photographer whenever possible.

The Client is not permitted to:

  • use the photographs for commercial purposes without prior written permission from the Photographer,
  • sell, license, or provide the photographs to third parties,
  • present the photographs as their own work or the work of another person,
  • significantly alter, edit, apply filters, or otherwise modify the photographs in a way that changes the Photographer's artistic style and creative vision.

Minor technical adjustments for personal use, such as cropping a photograph for printing or social media formatting, are permitted and do not constitute a breach of these Terms and Conditions.

Commercial use of the photographs, including advertising, promotion of products or services, business websites, publications, or marketing materials, requires prior written consent from the Photographer and may require a separate licensing agreement.

In the event of unauthorised commercial use or infringement of the Photographer's copyright, the Photographer reserves the right to request removal of the photographs, compensation for damages, and appropriate licensing fees.

Wedding vendors (such as wedding venues, planners, florists, makeup artists, or other suppliers involved in the wedding) may use photographs for the purpose of presenting their work only with prior agreement from the Photographer and always with proper credit to the Photographer.

XVI. CONSENT TO USE OF PHOTOGRAPHS FOR THE PHOTOGRAPHER'S PORTFOLIO

By entering into the Photography Services Agreement, the Client agrees, pursuant to Section 84 of the Czech Civil Code, that the Photographer may capture their likeness during the photography session.

The Client further agrees, pursuant to Section 85 of the Czech Civil Code, that the Photographer may use photographs showing the Client's likeness for presentation purposes, including:

the Photographer's portfolio,

website,

social media channels,

promotional materials.

If the Client does not wish for photographs to be published, they must inform the Photographer before booking the photography date.

Sharing photographs allows the Photographer to present their work to future clients. If the Client requires complete privacy, this must be communicated before the reservation is made.

XVII. PERSONAL DATA PROTECTION

In order to provide photography services, the Photographer must process certain personal data of the Client.
